1. Agreement to Terms

By accessing or using our services, website, or engaging in any project with Elevated Home Pros (“Company”, “we”, “our”), you (“Client”, “you”, “your”) agree to be bound by the following Terms and Conditions (“Terms”). If you do not agree, you must refrain from using our services or website.

2. Scope of Services

Elevated Home Pros provides construction, renovation, and installation services, including but not limited to deck building, screen rooms, motorized screens, and related outdoor living improvements. Services are provided based on written estimates, signed agreements, or contracts issued by the Company. Verbal commitments are not binding unless confirmed in writing.

3. Estimates and Pricing

All estimates are non-binding until a formal agreement is signed. Final pricing may vary based on material costs, scope changes, or unforeseen site conditions. We reserve the right to revise pricing upon discovery of such conditions, subject to Client approval.

4. Payment Terms

Unless otherwise specified in writing, payment is due in phases:

  • 50% deposit upon contract execution
  • 25% at project midpoint
  • 25% upon completion

Late payments may incur interest at the rate of 1.5% per month (18% annually) or the maximum allowed by Tennessee law. Non-payment may result in work stoppage and lien placement under Tennessee’s Mechanics' Lien Law (Tenn. Code Ann. § 66-11-101 et seq.).

5. Permits and Approvals

The Company will assist in obtaining local permits when required but ultimate responsibility lies with the property owner unless otherwise agreed. The Client must secure HOA approvals (if applicable) prior to construction. Delays due to permitting or HOA disputes are not the responsibility of the Company.

6. Warranties

Workmanship is warranted for one (1) year from the date of completion. This warranty excludes:

  • Damage from natural disasters
  • Misuse, neglect, or modifications by others
  • Material failure not caused by workmanship (covered by manufacturer warranties)

No other warranties, express or implied, are provided.

7. Project Timelines

Estimated start and completion dates are subject to weather, permit approvals, material availability, and other unforeseen delays. Elevated Home Pros shall not be held liable for delays beyond its control.

8. Changes and Cancellations

Any requested changes to the scope of work must be submitted in writing and may require a change order and additional fees. Cancellations after contract execution are subject to cancellation fees to cover administrative and material procurement costs.

9. Limitation of Liability

To the fullest extent permitted by law, Elevated Home Pros shall not be liable for indirect, incidental, or consequential damages. Total liability for any claim related to the services provided shall not exceed the amount paid by the Client for those services.

10. Intellectual Property

All website content, branding, and marketing materials are the property of Elevated Home Pros and may not be copied or used without written consent.

11. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the State of Tennessee. Any disputes shall be resolved in the state or federal courts located in Davidson County, Tennessee.

12. Privacy

We respect your privacy. Any personal information submitted through our website or during the project process is used solely for business purposes and is not sold or shared with third parties except as required to fulfill project obligations.

13. Updates to Terms

Elevated Home Pros reserves the right to modify these Terms at any time. Updates will be posted on our website and will become effective upon posting.
